RELATIONSHIP OF ISLAMIC LAW WITH OTHER LEGAL SYSTEMS

Islamic law emerged with its basic concepts, institutions and principles over a period of approximately two hundred years after the advent of Islam and generally carried out its formation. Various views have been expressed on whether or not other legal systems that preceded or were contemporary with it influenced its emergence and formation. These views can be broadly divided into three groups. The first group includes researchers who argue that Islamic law is based on Roman law. Researchers in the second group argue that Islamic law was not influenced by other legal systems, but rather that others were influenced by it. Researchers in the third group argue that the influence of other legal systems on Islamic law was not on its origin and formation, but was in the sphere of public law in later periods and remained very limited. This article examines the relationship between Islamic law and other legal systems based on the above three views and examines the extent to which mutual influence was realized.
