PROBLEMS OF EVIDENCE AND EVIDENCE IN INTERNATIONAL COMMERCIAL ARBITRATION

This article examines the main features of evidence and the process of proof in international commercial arbitration. The issue of presenting evidence continues to be a controversial topic widely discussed in the scientific community. The views of specialists on these issues determined largely by their legal education and the traditions of the legal system of the state in which they practice. Unlike the national laws of states, in international commercial arbitration, there are no clear and binding rules on the evidentiary procedure for the parties, which allows the parties to choose independently the rules within which the process conducted. The study also touches on current problems in the development of the institution of evidence and the main trends in this process that have developed now.
