The purpose of the scientific article is to give a legal character to the most ancient legal monuments - the laws of Hammurabi and the laws of Manu, as well as to analyze the stages of their historical formation. Since ancient legal acts are similar in essence, they have their own characteristics. The methodological basis of the study is comparative, chronological and systematic methods. As a result of the scientific research, the author comes to the following conclusions. When comparing the laws of Manu and Hammurabi as legal monuments of the ancient East, the absence of religious rites in the laws of Hammurabi is noticeable. It can also be considered as the first clear legal act in the history of mankind. On the other hand, in the laws of Manu, the supremacy of law is closely related to religious and moral norms, and it can be noted that religion and law are often mixed.
