ABOUT THE ESSENCE AND CONCEPT OF JUDICIAL ACTIVITY

Abstract

Relevance: Meanwhile, in the light of today's reforms, determining the essence and characteristics on the basis of which it is planned to determine the ways to improve the judiciary is indispensable in determining measures to improve the judiciary. Considering the judicial activities as a means of realizing justice, it should be noted that there is no consensus among researchers on the relationship of these mutually conditioned phenomena. Often, researchers also include signs of judicial activity in the concept of justice.

From our point of view, the true essence of the judiciary is to be considered as the possession of enforcement powers in the legal sphere of social life and the exercise of these powers in accordance with procedural law. However, even here there is a mixture of the characteristics of power (powers) with the form of its implementation, because the exercise of powers is judicial activity, that is, the realization of power.
