RELATIONSHIP OF THE INDEPENDENCE OF JUDGES WITH THEIR RESPONSIBILITY, SUBMISSION TO THE CONSTITUTION OF THE KYRGYZ REPUBLIC AND THE LAW

Abstract

The article deals with the modern development of the theory and practice of judicial activity is characterized by insufficient scientific development of the problem of the independence of justice as a principle of a constitutional and legal nature. At the same time, in the current conditions, the public importance of the independence of justice is significantly increasing. This is due to the need to overcome the alienation of state structures and civil society, excessive "vertical" in the hierarchy of judges and officials of the judiciary, the insecurity of a number of constitutional rights and freedoms of man and citizen, as well as, often, a formal approach to the administration of justice, leading to the actual failure of judicial systems from effective protection of the violated rights and legitimate interests of the subjects of legal relations.
